Signed lien waivers

On a project in a state that requires signed lien waivers, the GC company's Owner seat can require each payee to sign its conditional lien waiver before a payment goes out. It is off unless that seat turns it on, and it is offered only in those states.

1. Turn it on or off

1. Open the project and choose the Funding tab.

2. Under Lien Waivers, tick Require signed lien waivers on this project.

3. To turn it off, clear the same box.

Only the GC company's Owner seat sees the box, and only on a project in a state where it is offered. It can be turned on only before the first payment into the project is funded, and turned off at any time. Each change is recorded on the project's audit trail.

2. What changes when it is on

When the Owner seat sends a payment, VisiPay prepares each payee's conditional lien waiver and holds the payment until the payee signs it. Nothing in that payment is paid while one of its waivers is unsigned.

When the last waiver is signed, the payment goes out if everything else is still ready. If something else is holding it, the signature stands and the payment goes out when the Owner seat sends it again. Nobody signs twice.

If the box is cleared, a payment on hold only for a signature goes out if everything else is ready.

If the project address moves to a state where it is not offered, it turns off by itself, and that change is recorded too.

3. Who signs

  • The payee company's Owner seat.
  • Or the member that Owner seat names as its waiver signer.
  • Nobody outside the payee company can sign it.

4. Sign a waiver

1. When a waiver is waiting for you, your dashboard shows Waiting on your signature, and VisiPay sends you reminders by email while it waits. Open the link. If you hold a seat on the project, the Signature column of its Lien Waivers list also offers Sign.

2. Read the waiver. Signing is the last step: if everything else on the payment is ready, the payment goes out the moment you sign.

3. Tick the box to agree to sign electronically.

4. Type your name.

5. Choose Email me a code, then enter the 6 digit code from the email. You need a new code each time you sign, even when you are already signed in. If the code stops working, choose Email me a new code.

6. Choose Sign the lien waiver, then Yes, sign it. Choose Go back to change anything first. A signed waiver cannot be unsigned.

Until every step is done, the screen lists what is still needed. If signing fails, what you typed stays, so you can fix it and try again.

Open the same link again at any time to read the waiver as you signed it, with your name and the time.

Signing opens once the electronic records consent is published. Until then the screen says signing is not open yet, and nothing needs doing.

5. Who sees a signature

  • The GC and the Owner see whether each waiver is signed or awaiting a signature, and when. They see who signed it under the project's name rules: your own company's people by name, another company by its name and role, and the Owner sees a Sub's waiver by its Subcontractor letter.
  • A Sub sees its own company's waivers only.
  • A lender sees whether each waiver is signed, and when. No amount and no name.
  • VisiPay support sees the status and the time, never a name.
  • A signed waiver that no longer matches what was signed is flagged on the project's Lien Waivers list.

6. Name your company's waiver signer

1. Open Settings and find Lien waiver signer with your company's name.

2. Choose a member, then Name as signer, then Yes, save.

3. To change it, choose another member the same way. To stop, choose Name nobody, then Yes, save.

Only your company's owner can change it; every other member sees who is named. Each change is recorded on the audit trail. If your company has no other member yet, invite a teammate under Team first.
